SPECIAL COUNCIL ORGANIZATION MEETING 

4:00 PM

Mayor William Troxell took the chair and gavel and called the organization of Council meeting to order with the following councilors present: Mr. Jacob Schindel, Mr. John Butterfield, Mrs. Susan Naugle, Mr. Graham Weaver, Mr. Kyle Leinbach, Mr. Scot Pitzer. Mr. Michael Birkner participated in the meeting via telecommunications/Skype and Mr. Robert Krummerich via telephone. Ms. Rebecca Brown was absent. Staff present included: Borough Secretary Sara Stull, Solicitor Harold Eastman, Finance Director Nickie James and Planning Director Scott Dellett.

Others present include: Stan Clark, 915 Fairview Avenue and Steven Hemler, 535 York Street.

Representing the press was Jim Hale of the Gettysburg Times.

The Mayor will now administer the Oath of Office to the re-elected and newly elected Councilors: 1st Ward: Mr. Scot Pitzer: and 3rd Ward: Mr. Graham Weaver.

Mayor Troxell addressed the audience explaining when a person is elected to serve as the president of Borough Council, the Council conveys to that person the authority and the responsibility to: preside over Borough Council meetings; appoint members to standing and special committees; and sign certain contracts authorized by the Council. A Council Vice President is elected to perform the duties of the president when the president is unable or unavailable to serve. Mayor Troxell pointed out each shall serve at the pleasure of the Council

Mayor Troxell entertained a motion and second to nominate and elect one of the Councilors as President.

Moved Mr. Weaver, seconded Mr. Butterfield to nominate Mr. Birkner as Council President. Roll call vote: YEA: Mr. Krummerich, Mr. Butterfield, Mr. Weaver, Mrs. Naugle and Mr. Birkner. NAY: Mr. Pitzer, Mr. Leinbach and Mr. Schindel: The vote passed 5 - 3.

Mayor Troxell entertained a motion and second to nominate and elect one of the Councilors as Vice President.

Moved Mr. Leinbach, seconded Mr. Pitzer to nominate Mr. Schindel as Council Vice-President. Roll call vote: YEA: Mr. Pitzer, Mr. Leinbach, Mr. Krummerich and Mr. Schindel. NAY: Mr. Butterfield, Mr. Weaver, Mrs. Naugle, and Mr. Birkner. The vote was a tie 4-4 with Mayor Troxell casting a vote for Mr. Schindel.

The newly elected Vice President Jacob Schindel assumed his chair to proceed with the meeting.

Moved Mr. Leinbach, seconded Mr. Butterfield to adopt Robert's Rules of Order (11th edition, unabridged) as the official rules of order for the conduct of meetings. Motion carried unanimously.

Moved Mr. Schindel, seconded Mrs. Naugle to appoint John D. Butterfield as parliamentarian and president pro tempore. Motion carried unanimously.

Susan Naugle asked the solicitor to give an explanation for the need of this new motion appointing someone as a president pro tempore. Solicitor Eastman explained it is not required in the Borough Code, but that the purpose to elect someone would be so that they could chair a meeting if both the president and vice president were not present. 

Moved Mr. Leinbach, seconded Mrs. Naugle to adopt a resolution to:

Appoint Peter S. Marshall as Borough Manager and Borough Treasurer and set bond at $100,000. Borough will pay premium.

Appoint Sara L. Stull as Borough Secretary, and set bond at $100,000. Borough will pay premium.

Appoint Nicolette D. James as Finance Director and Assistant Treasurer, and set bond at $100,000. Borough will pay premium.

Appoint Scott Dellett as Planning Director and Zoning Officer.

Appoint Joseph F. Dougherty as Chief of Police.

Appoint Daniel A. Hilliard as Public Works Director.

Appoint David Sanders as Emergency Management Director.

Appoint Harold A. Eastman Jr. as Solicitor and Richard E. Thrasher as Assistant Solicitor.

Appoint the firm of C. S. Davidson Inc. as Borough Engineers.

Appoint Mayor Troxell as the voting delegate to the PSAB Annual Conference. 

Appoint Edward G. Puhl as Chairman of the Vacancy Board.

The motion carried unanimously.

Moved Mr. Leinbach, seconded Mr. Pitzer a single motion is offered for adoption to:

Hold the 2014 monthly Borough Council Meetings on the following dates at 7:00 PM, prevailing time, in the Municipal Building, and authorize the Borough Secretary to advertise same in the Gettysburg Times:

Monday January 13th, Monday February 10th, Monday March 10th, Monday April 14th, Monday May 12th, Monday June 9th, Monday July 14th, Monday August 11th , Monday September 8th, Tuesday October 14th, Monday November 10th, and Monday December 8th.

The motion carried unanimously.

Mayor Troxell noted for the record that he felt it necessary to vote for Jacob Schindel as the vice president since Council had never voted him out of that position. 

Moved Mr. Leinbach, seconded Mr. Pitzer to adjourn the meeting at 4:30 PM.
