 March 14, 2011

President John Butterfield called the meeting to order at 7:00 PM with the following Councilors present: Mr. Theodore Streeter, Mr. Michael Birkner, Mrs. Susan Naugle, Mr. Robert Krummerich, Mrs. Claire Lewis, Mr. Graham Weaver and Mayor William Troxell. Ms. Alice Estrada was absent. Staff present included Manager Florence Ford, Borough Secretary Sara Stull, Solicitor Harold Eastman, Chief Joseph Dougherty, Finance Director Ramona Overton and Planning Director Scott Dellett.

Others present included: John Spangler, Lutheran Seminary; Leonard Loski, Gettysburg Area Retail Merchants Association; Jacob Schindel, Ragged Edge Coffee House; Kyle Leinbach, Tipton's Grill and Kathy Gilbert, 39 South Street.

Representing the press were Scot Pitzer of the Gettysburg Times, and Tim Prudente representing the Evening Sun

President Butterfield announced an executive session of the Gettysburg Borough Council was conducted immediately following the adjournment of the Borough Council meeting held on February 28, 2011 consistent with Sections 708(a)(1) and 708(a)(2) of the Sunshine Act..

The agenda was approved as presented.

With no changes to the February 28, 2011 minutes, they were accepted as written.

Special Presentation:

John Spangler, Executive Assistant to the President, Gettysburg Lutheran Seminary, attended to give a brief report on the Historic Walking Tour Pathway Project. He attended the Public Safety/Public Works Committee and is attending tonight to request a letter of support for the Transportation Enhancement Project as required by Penn DOT.

Ted Streeter asked if there is sufficient parking. Mr. Spangler responded they have parking at the Seminary and noted Pete Monahan; a neighboring property has expressed interest in the project.

Graham Weaver asked the completion date of the project. Mr. Spangler answered it is not a long construction project and that it should be completed by the end of fall.

Michael Birkner commended the Seminary for the project stating it connects beautifully with the 150th upcoming events. Jake Schindel reiterated it's a nice project and that he enjoys running and would utilize the trail.

John Butterfield announced the Adams County Arts Council presented the Borough with the Applause Award. It is in recognition of outstanding leadership, vision and commitment to the arts and cultural life of Adams County. He asked Manager Ford to inform staff of this award at the next staff meeting.

Holly Giles reported the College Community Committee will meet on Tuesday, March 22nd at 5:00 PM.

Moved Mr. Birkner, seconded Mr. Weaver to enact an ordinance of the Borough of Gettysburg regulating special events within the Borough. Motion carried unanimously.

Moved Mr. Birkner, seconded Mrs. Lewis to adopt a resolution setting the fees for the application for and the issuance of special events permits under the ordinance. Motion carried unanimously.

Moved Mr. Birkner, seconded Ms. Giles to designate the Borough as the sponsor for the bid opening for the Lutheran Seminary Trail Transportation Enhancement Project. Motion carried unanimously.

Manager Ford pointed out the Borough as the host municipality is only opening the bids for the Seminary. Graham Weaver asked if there is any financial exposure to the Borough. Manager Ford responded no just to use the facility to open the bids.

Manager Ford asked Council to review the Street and Alley Pavement Evaluation and Recommendations report provided by C. S. Davidson. If anyone has any street issues they should let her know.

Moved Mrs. Naugle, seconded Mrs. Lewis to accept the resignation from Robert Kornack from the Gettysburg Zoning Hearing Board effective March 1, 2011. Motion carried unanimously.

Moved Mrs. Naugle, seconded Mr. Weaver to adopt a resolution reappointing Paul Kendlehart to the Code Enforcement Appeals Board for a five year term expiring on March 15, 2016. Motion carried unanimously.

Moved Mr. Krummerich, seconded Mr. Streeter to approve all bills and payroll for the month as presented. Motion carried unanimously.

Moved Mr. Streeter, seconded Mr. Krummerich to authorize Council to schedule a public hearing at 6:45 PM on Monday, March 28, 2011, to modify the 2009 and 2010 CDBG budgets. Motion carried unanimously.

Moved Mr. Streeter, seconded Mr. Krummerich to approve and authorize the issuance of a certificate of appropriateness for item A. (111 Seminary Ridge) as set forth in the minutes of the February 16, 2011 meeting of HARB consistent with the findings and recommendations of HARB as set forth therein. Motion carried unanimously.

Solicitor Eastman gave a report regarding the Gettysburg Area Industrial Authority (GAIDA) as instructed by Council at its last meeting. He was informed by Attorney White that the procedure is that the Board must present Council with a letter of certification for approval. This would then be forwarded to the State for processing and the Secretary of the Commonwealth would send notification ceasing the GAIDA Board.

Holly Giles asked if Attorney Robert McQuaide had been contacted yet. Solicitor Eastman responded he wanted to report his findings to Council first and would then follow up with Attorney McQuaide.

Susan Naugle asked if they would remain an active Board until this occurs. Solicitor Eastman responded yes but he doesn't believe this is a long process.

Manager Ford reviewed the sign proposals from Len Dick Signs. Council asked to look at a more "historical sign" look from the 1800's. Manager Ford will take this back to Len Dick.

Manager Ford announced Little League opening day is Saturday, April 16th. They plan to have special events and invited Council to attend. If anyone is interested should let Flo know.

Moved Mr. Streeter, seconded Mr. Weaver to authorize a letter of support for the development of an Adams County Economic Development Plan. Motion carried unanimously.

With no further business to come before council moved Ms. Giles, seconded Mr. Streeter to adjourn the meeting at 7:50 pm.
