LEGAL NOTICE

Notice is hereby given that the Borough Council of the Borough of Gettysburg, Adams County, Pennsylvania intends to enact, adopt and ordain the following proposed ordinance on Monday, November 26, 2018 at a special business meeting of Borough Council, commencing at 6:45 P.M. in the Borough Council Chambers at the Gettysburg Borough Municipal Office Building, 59 East High Street, Gettysburg, Pennsylvania.  The title as well as a brief summary of the principal provisions of the Ordinance is as follows:

AN ORDINANCE OF THE BOROUGH COUNCIL OF THE BOROUGH OF GETTYSBURG, ADAMS COUNTY, PENNSYLVANIA, SIGNIFYING THE INTENTION AND DESIRE OF THE BOROUGH OF GETTYSBURG, ADAMS COUNTY, PENNSYLVANIA TO ORGANIZE A MUNICIPAL AUTHORITY UNDER THE PROVISIONS OF THE ACT OF THE GENERAL ASSEMBLY, KNOWN AS THE MUNICIPALITY AUTHORITIES ACT, 53 PA.C.S. CHAPTER 56; SETTING FORTH AND AUTHORIZING EXECUTION OF ARTICLES OF INCORPORATION; APPOINTING AND FIXING THE TERMS OF THE FIRST MEMBERS OF THE BOARD OF SUCH AUTHORITY; AUTHORIZING ALL OTHER NECESSARY ACTION; AND REPEALING ALL INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES.

                SECTION 1:  This section indicates the agreement of Borough Council to organize a municipal authority under the Municipality Authorities Act to be known as the Gettysburg Borough Stormwater Authority.

                SECTION 2:  This section sets forth the purposes and powers of the Authority to administer and assess related fees in connection with the construction, operation, maintenance and repairs necessary for the implementation and operation of the Borough’s municipal separate storm sewer system.

                SECTION 3:  This section authorizes and directs the President or Vice President of Borough Council and the Secretary of the Borough of Gettysburg to execute Articles of Incorporation for the Authority.

                SECTION 4:  This section authorizes the Borough Secretary to publish notice of the enactment and adoption of the Ordinance as required by the Authorities Act.

                SECTION 5:  This section authorizes and directs the Borough Secretary to file such Articles of Incorporation for the Authority as well as necessary proofs of publication with the Secretary of the Commonwealth of Pennsylvania and to pay all required filing fees.

               SECTION 6:  This section appoints five initial members of the Board of the Authority, to serve staggered terms ranging from one to five years in length.

               SECTION 7: This section repeals all other inconsistent ordinances or parts of ordinances of the Borough of Gettysburg.

              SECTION 8:  This section indicates that any provisions of the Ordinance which may be found illegal, invalid or unconstitutional shall not affect or impair the remaining portions of the Ordinance.

               SECTION 9:  This section provides for the immediate effectiveness of the Ordinance.

A copy of the full text of the proposed Ordinance may be examined without charge or obtained for a charge not greater than the cost thereof at the Office of the Borough of Gettysburg from the Borough Secretary during regular business hours (Monday through Friday, 8:00 A.M. – 5:00 P.M.).  An attested copy of the proposed Ordinance has been filed in the Adams County Law Library, Room 305, Adams County Courthouse, 117 Baltimore Street, Gettysburg, Pennsylvania and may examined without charge during regular business hours (Monday through Friday, 8:00 A.M. – 4:30 P.M.).  The proposed Ordinance may be downloaded from the Gettysburg Borough website at www.gettysburgpa.gov.
